The Head Officer of the County of Żary
announces herewith the 3st open auction for the sale
of the ownership of a developed property situated in the
area of Olszyna,
Commune of Trzebiel and in the area of Jeziory Wysokie,
Commune of Brody
1. The developed property of the State Treasury, the former
Olszyna road border-crossing point, built up with twenty
five buildings together with the facilities of technical
infrastructure, machines and equipment functionally related
to the buildings, entered in the register of land and
buildings as the land parcels number:
the property in the area of Olszyna, Commune of Trzebiel:
- land parcel number 223/1, the area of 7.7958 hectares,
with the following buildings:
a) an administrative building of the usable area of 6,099.51
m²,
together with an oil boiler house with a fuel storage room
and smoke stack, a cable broadcast center for information
announcing in the area of the terminal, center of fire
signaling to signal smoke and fire
b) garages for company cars of the usable area of 434.1 m²,
c) a building for dogs of the usable area of 39.2 m²,
d) an umbrella roof for automobile equipment of the usable
area of 202.5 m²,
e) a sanitary pavilion of the usable area of 78.2 m²,
f) a building for quick customs clearing of the usable area
of 65.3 m²,
g) a building of final control of the usable area of 17.1 m²
the land parcel is equipped with an electronic platform
vehicle scales to weigh heavy motor vehicles,
- land parcel number 222/2 of the area of 0.3461 hectares,
- land parcel number 225 of the area of 0.0716 hectares,
with the following buildings:
a) a building of a transformer station of the usable area of
258.79 m² with power generators to generate electric power,
distribution board of medium and low voltage to connect and
break, and to distribute electric circuits, oil transformers
to change the electric voltage, a rectifier to charge the
batteries of emergency lighting, capacitor banks
in the area of Jeziory Wysokie, Commune of Brody:
- land parcel number 1178/2 of the area of 2.7988 hectares,
with the following buildings:
a) garages for company vehicles of the usable area of 158.0
m²,
b) control building exit A of the usable area of 28.2 m²,
c) control building exit B of the usable area of 28.2 m²,
d) control building exit C of the usable area of 28.2 m²,
e) control building exit D of the usable area of 28.2 m²,
f) control building exit E of the usable area of 28.2 m²,
g) control building exit F of the usable area of 28.2 m²,
h) an umbrella roof of the control buildings,
the land parcel is equipped with an electronic platform
vehicle scales to weigh heavy motor vehicles,
- land parcel number 482/17 of the area of 6.2911 hectares,
with the following buildings:
a) a sanitary pavilion of the usable area of 78.2 m²,
b) a building for quick customs clearing of the usable area
of 65.4 m²,
c) a building for customs clearance of the usable area of
1,407.09 m² with scissor lifts and adjustable ramps
d) a building of vehicle inspection of the usable area of
853.8 m² with a scissor lift, a tubular rail, overhead
traveling double-girder crane to lift and transport objects
e) a building of veterinary customs clearing of the usable
area of 561.56 m² together with a telpher to lift and
transport objects overhead, tube rail, scissor platform and
adjustable ramps.
The land parcel is equipped with an electronic platform
vehicle scales to weigh heavy motor vehicles.
- land parcel number 1164/2 of the area of 0.9731 hectares,
with the following buildings:
a) an administrative building of the usable area of 5,343.72
m²,
together with an oil boiler house with a fuel storage room
and smoke stack, a cable broadcast center for information
announcing in the area of the terminal, center of fire
signaling to signal smoke and fire,
b) a building of the usable area 115.0 m²,
with a power generator to generate electric power
c) a garage building of the usable area 35.91 m²,
- land parcel number 482/15 of the area of 0.1014 hectares,
with the following buildings:
a) a building of a transformer station of the usable area of
258.79 m² with power generators to generate electric power,
distribution board of medium and low voltage to connect and
break, and to distribute electric circuits, oil transformers
to change the electric voltage, a rectifier to charge the
batteries of emergency lighting, capacitor banks
The total area of the property is 18.3779 hectares.
2. For the properties situated in the area of Olszyna,
Commune of Trzebiel there is no valid land development plan.
Under the provisions of the study of conditions and
directions of the spatial management of the Commune of
Trzebiel resolved by the Council of the Commune of Trzebiel,
resolution No. XXII/99/2000 of November 21, 2000, the
subject property is situated in the area marked with U8
symbol, i.e. services, the developed area to be adapted and
supplemented. The land parcel No. 225 is to be developed as
NS – transformer station.
The properties located in the area of Jeziory Wysokie,
Commune of Brody are subject to the valid land development
plan of the Commune of Brody resolved by the National
Commune Council, resolution No. III/12/88 of December 29,
1988, amended by the Commune Council of Brody, resolution
No. XII/101/95 of 12.20.1995. Under the plan, the property
is situated in the area marked ZI-KS, B, S, U, WZ – the area
designed for construction of a cargo customs clearance for
the border-crossing point in Olszyna.
Whereas, under the study of conditions and directions of the
spatial management of the Commune of Brody resolved by the
Commune Council of Brody, resolution No. XIII/62/99 of
August 4, 1999, the subject property is situated in the area
marked as follows:
- land parcels No. No. 482/15, 1164/2 – area of services (UA
– administration),
- 482/17 the area of road transport and the area of
administration services,
- land parcel No. 1178/2 – the area of business activities.
3. The properties located in the area of Olszyna, Commune of
Trzebiel are entered in the land and mortgage register under
the number 49855, and the properties located in the area of
Jeziory Wysokie, Commune of Brody are entered in the land
and mortgage register under the number 45689.
1. The property is free of any encumbrances and liabilities.
2. The initial price for the property is PLN 32.500.000.
3. The bid deposit is PLN 3 250 000 and it may be covered with
a bank guarantee.
4. Under Section 43, Item 1, Point 1, Letter a of the VAT
Act, the property is exempted from VAT payment.
5. The auction shall be held on March 15, 2011 in Room
No. 108 of the County Administrator's Office [Starostwo
Powiatowe] in Żary, 5 Aleja Jana Pawła II at 12:00.
6. Any participation in the auction is conditioned by the
payment of the bid deposit to the account of Starostwo
Powiatowe w Żarach Aleja Jana Pawła II nr 5, PKO BP S.A.
Oddział Żary account number 21 10205460 0000510200060517 so
that the required amount be received at the said account not
later than on March 10, 2011.
7. Any natural persons to participate in the auction must
submit a receipt for payment of the bid deposit and an
identity card, and any persons to represent a corporate body
must submit an appropriate letter of authority.
8. The bid deposit paid by the winner of the auction shall
be included in the purchase price.
9. The bid deposits of any natural person or corporate body
who will not win the auction shall be refunded within 3 days.
10. The bid sale price of the property including the price
of the land, buildings and facilities shall be paid and
received by Starostwo Powiatowe not later than one day prior
to the signature of a notarial deed of the purchase.
11. The bid deposit shall be forfeited unless the winner of
the auction appears in the Notarial Office on the agreed
date of conclusion of the contract.
12. The costs related to the signature of the notarial deed
and court fees shall to be incurred by the purchaser.
13. The announcer of the auction may cancel the auction due
to important reasons only and in such case they shall
announce the cancellation of the auction to the public and
inform about the reason therefor.
14. The auction shall be held in accordance with the
Ordinance of the Council of Ministers of September 14, 2004
pertaining to the manner and procedures of holding auctions,
tenders and negotiations with reference to alienation of
real estate (Journal of Laws No. 207, Item 2108).
